Con mensaje de urgencia, el Gobierno nacional radicó ante el Congreso de la República el proyecto de ley que tiene como finalidad fortalecer la seguridad ciudadana, endureciendo penas y buscando frenar la reincidencia en el país. «La intención del Gobierno, en conjunto con el Congreso, alcaldes y gobernadores, es trabajar en un texto que permita fortalecer las sanciones en materia penal para el hurto, las lesiones personales, el daño en bien ajeno, el homicidio; verificar y fortalecer la medida de aseguramiento, el Código de Policía y la restricción para el porte de armas traumáticas», afirmó el ministro del Interior Daniel Palacios.
Frente a los delitos en contra de la Fuerza Pública, el jefe de cartera explicó que cuando se trate de un homicidio «tendrá la mayor sanción posible del Código Penal, llegando a los 60 años de cárcel, 58 si son mujeres»; mientras que si son lesiones personales «no serán un delito excarcelable, y llevará una condena de entre 4 y 17 años de prisión».
En esa misma línea destacó que «cuando se cometa daño en bien ajeno, sobre la infraestructura destinada a la seguridad ciudadana, al transporte público masivo, a las instalaciones Militares, de Policía, o de servicio a la justicia, las penas tampoco podrán ser excarcelables, con una condena de 4 a 12 años de cárcel».
Con el fin de enfrentar la impunidad y la reincidencia, según Palacios, la iniciativa plantea justamente «la sanción de reincidencia, para quienes hayan sido condenados a delitos agravados en los últimos cinco años, o para quien haya incurrido en ese delito con el porte o uso de un arma blanca”.
A propósito, el ministro de Defensa Diego Molano advirtió que «solo en Bogotá, en el último mes y medio, alrededor de 7.033 personas fueron capturadas, 6.133 en flagrancia y 9.387 por orden judicial. De los capturados en flagrancia quedaron en libertad 5.000. Es decir, el 86%. Es por esto que este proyecto de ley busca generar soluciones estructurales a estos problemas”.
Dentro del proyecto también se plantean modificaciones al Código Penal que permitan establecer como tipo penal la intimidación o amenaza con arma de fuego, armas y elementos menos letales, armas hechizas y armas blancas (pena de 48 a 72 meses); y agravar la pena del delito de hurto en relación con las cuantías.
Además, si la persona porta armas blancas en medio del trasporte público o durante un evento masivo, será considerado un delito también de tipo penal. Igualmente se incluirá dentro de esta tipificación el porte y fabricación de armas, la utilización de armas, elementos o dispositivos menos letales.
Finalmente, de acuerdo con Molano, el proyecto pretende beneficiar a la Fuerza Pública, creando el derecho a la gratuidad en el acceso al servicio de transporte público masivo, la atención preferencial y prioritaria por parte de las entidades del orden nacional, municipal y distrital; así mismo plantea otorgar descuentos en tiquetes aéreos, hoteles y transporte público dentro del país.
Para que se convierta en una realidad, el proyecto deberá superar con éxito sus cuatro debates entre Senado y Cámara de Representantes. Como tendrá el mensaje de urgencia por parte del Gobierno nacional, se espera que la discusión en Comisiones Primeras, para lo que será su primer debate, se lleve a cabo mediante una sesión conjunta. Posteriomente, de ser aprobado, quedará en manos de las Plenarias de ambas cámaras.
