Una Auditoría de Cumplimiento que realizó la Contraloría General de la República a la Caja de Compensación Familiar del Caquetá (Comfaca) concluyó encontrando 27 hallazgos administrativos, de los cuales 12 tienen presunta incidencia fiscal por $17.144 millones.
La auditoría, realizada por la Contraloría Delegada para el Sector Trabajo en el segundo semestre del 2021, tuvo por objeto verificar el cumplimiento de los marcos normativos y reglamentarios relacionados con el manejo de los recursos parafiscales por parte de esta entidad (el aporte del 4% y otros para atender la emergencia por el Covid-19), en las vigencias 2019 y 2020.
El hallazgo de mayor cuantía se deriva de que COMFACA, durante estas dos vigencias auditadas, superó los límites máximos de gastos de administración en una cuantía de $12.434. millones, lo que equivale al 23.41% del total de los ingresos recaudados en 2019 y el 21.38% en 2020.
Los gastos administrativos fueron redistribuidos en los centros de costos correspondientes a cada servicio que brinda la Caja de Compensación Familiar, como educación, recreación, deporte, escuelas de formación, crédito y otros.
Esto dejó como consecuencia una afectación de los recursos que por ley estaban destinados a fines específicos, siendo estos utilizados para financiar gastos administrativos.
En otro hallazgo, la CGR verificó que COMFACA está dando uso inadecuado o no permitido a los recursos parafiscales del 4%, dado que tiene un sistema de crédito por libranza y algunos de los tipos de crédito no están incluidos en la normatividad que rige a las Cajas de Compensación Familiar.
Tal situación se presenta desde la vigencia 2003, por deficiencias en el seguimiento de créditos por parte de los directivos de la Caja de Compensación, incumpliendo la normatividad establecida respecto a tipos o líneas de crédito, generando destinación de recursos de parafiscalidad a actividades no previstas ni aprobadas por la normatividad, lo que da pie a posibles sanciones penales, disciplinarias y un daño patrimonial por cuantía de $3.406 millones.
Se determinó también el uso de recursos correspondientes a Obras y Programas Sociales provenientes del 4% para financiar actividades económicas distintas a las autorizadas por la Ley, lo que permitió a la Contraloría establecer un hallazgo fiscal por valor de $1.100 millones.
Esto se dio cuando través del contrato No.5-135 suscrito entre COMFACA y el CONSORCIO ALIANZA COLPATRIA, se financiaron compromisos por medio de dos notas bancarias, la primera por $285.000.000 y la segunda por $815.000.000, sin que a la fecha se haya reintegrado el recurso a la cuenta Obras y Programas Sociales.
Pagos sin soportes
El ente de control también evidenció una serie de novedades que no permitieron que se cumpliera a cabalidad un contrato suscrito por COMFACA, por $965.426.305, para la construcción de tres piscinas (piscina de niños, piscina de tobogán y piscina asoleadora), en el Centro Recreacional La Manigua.
Adicionalmente, en septiembre de 2020 se realizó una prórroga de 2 meses y al mes siguiente de la misma, se rediseñaron las piscinas y se calculó el alcance definitivo, que necesitó la implementación del Reglamento Técnico para Parques de Diversiones, Atracciones o Dispositivos de Entretenimiento Familiar, RETEPARQUES.
Igualmente, hubo dos cierres de la obra por parte de la Policía Nacional por no contar con la licencia de construcción tanto para la ampliación como, posteriormente, para el reinicio de esta. Además, en mayo de 2021 se suspendió la obra por el paro nacional y finalizaron el contrato el 26 de octubre de ese mismo año.
Pese a lo anterior, la Caja de Compensación realizó un anticipo del 30% pactado en el contrato por $16.317.797 e hizo un pago parcial amortizando un nuevo 30% por $16.317.797, para un total pagado de $32.635.594. Estos pagos se realizaron sin que el contratista hubiese presentado los productos soporte de la ejecución del contrato, consistente en informes de interventoría.
La CGR también evidenció que la COMFACA no realizó una adecuada gestión de cobro de la libranza y del pagaré y seguimiento de la cartera de créditos otorgados desde la vigencia 2007 hasta la 2014, permitiendo el vencimiento de las acciones de recuperación y realizando un importante castigo de cartera.
Además, la administración de COMFACA que realizó el castigo de cartera, no cumplió ningún tipo de actividad con sus trabajadores o extrabajadores que no realizaron gestión oportuna para recuperar los dineros, resultando en daño patrimonial por $40.059.938,69.
En la ejecución de esta Auditoría de Cumplimiento, la CGR verificó los fallos por demandas judiciales en contra de la Caja y determinó que perdió un proceso laboral ordinario por $61.163.808, que fue pagado el 24 de septiembre de 2019 con recursos parafiscales del 4%.
